HONORABLE Julie Gatti

Judge Julie Gatti graduated from Michigan State University with a Bachelor of Arts degree in 1989.  She received her Juris Doctorate from Wayne State University in 1995.  Judge Gatti was elected to the Circuit Court bench in November 2018.  Prior to her election, Judge Gatti was in private practice, specializing in Family Law.  She served 9 years on the Board of the Macomb County Bar Association (MCBA) and was elected its 85th President. She was the proud recipient of the MCBA’s Civility Award for 2017-2018.   Judge Gatti serves on the Board of Directors of The Resolution Center.  Additionally, she is a member of the Women Lawyers Association of Michigan - Macomb Region, the Italian American Bar Association of Michigan, and the Italian American Chamber of Commerce of Michigan.

SCHEDULING DAYS AND TIMES

ALL CASES

Motions: Civil and Criminal Motions and Creditor Exams: Monday at 8:30 a.m.,  MSD Motions at 10:00 a.m. and PPO Motions at 10:30 a.m.

Trials: Tuesday, Wednesday, Thursday, and Friday at 10:00 a.m.

Evidentiary Hearings: Friday at 9:00 a.m.

CIVIL CASES

EDSC/Status/Settlement Conferences:  Tuesday and Wednesday at 8:00 a.m.

Oral arguments on appeals: Monday at 8:30 a.m.

Summary Disposition Motions: Monday at 10:00 a.m.

PPO Motions: Monday at 10:30 a.m.

CRIMINAL

Arraignment/1st Pre-Trial:  Monday at 1:30 p.m.

Sentencing/Probation Violation/Show Cause/Review Hearings/Pre-Trial Hearings: Tuesday and Wednesday at 9:00 a.m.

Criminal Pretrials: Thursday 9:00 a.m.  

E-FILING

Electronic filing is mandatory for all current e-File cases and new civil matters with “C”, “N”, “AA”, “AE”, “AP”, “AR”, “AV”, or "P" case-types assigned to Judge Gatti.

After a complaint is filed in the Clerk’s Office, subsequent pleadings must be filed electronically on the Court’s eFiling website:  https://mifile.courts.michigan.gov.  Additional information can be found on the Court’s eFiling webpage:  http://circuitcourt.macombgov.org/CircuitCourt-eFiling.

Filings on existing cases and other case-types will not be affected.

The Court’s eFiling is governed by Administrative Order No. 2010-6.

 

POLICIES & PROCEDURES

ADJOURNMENTS

Adjournment requests of scheduled events are routinely handled by the Judge’s judicial secretary (Bridget (586) 493-5752).  After approval, a stipulation and order for 1st adjournment which includes the new date and is signed by all counsel shall be filed.

Adjournment requests for motions are handled by the clerk (Jessica (586) 463-2458) 

Adjournment of trials must be brought by motion with all counsel appearing as a new trial date will be provided if the request is granted.

ALTERNATE SERVICE

Requests for alternate service must be accompanied by a verified motion, proposed order, an affidavit of the process server showing reasonable efforts to make service of process and a postal verification.

APPEALS

No stipulation for extension of time to file briefs on appeal will be accepted.  The party seeking the extension must file a motion.

FACILITATION/MEDIATION

The Court strongly encourages all forms of Alternative Dispute Resolution during the pendency of litigation and is specifically authorized by local court rule to order parties into Facilitation.  You may use this form

MOTIONS

Judge Gatti requires one courtesy copy of any motion and brief and all accompanying exhibits, as well as responses and replies, be submitted directly to the judge’s chamber in paper format.

Any exhibits must be appropriately tabbed.  Good practice requires that in appropriate cases, relevant portions of lengthy documents be highlighted. 

Judge’s copies of responses to motion will not be accepted after 3:00 p.m. the Friday preceding the motion hearing.

Replies to responses are not accepted without prior court permission.

Following the Court’s ruling on a motion, parties shall sign and submit a proposed order which may be prepared on the Court's computer in the designated area.  

SCHEDULING ORDER

For most civil cases, Court Management issues a standard Discovery and Case Evaluation Order setting the schedule for discovery, witness lists, dispositive motions and case evaluation.  For the first request, Judge Gatti will permit a 60-day extension of the dates set forth in the Discovery and Case Evaluation Order by stipulation of the parties (you may use this form).  All new dates must be listed in the order or it will be rejected.  Any subsequent requests to extend the scheduling order dates must be made by motion and will only be granted upon a showing of good cause.  If a Case Evaluation Hearing is scheduled within 14 days of granting the adjournment, the parties must pay the $150.00 adjournment fee prior to submitting the order for entry.

SETTLEMENT CONFERENCES

Counsel, parties, and persons with settlement authority are ordered to attend the settlement conference unless their attendance has been excused by the court.

If a matter is resolved and an Order of Dismissal is entered before the conference date, the attorneys and parties need not appear for the conference.
